At the Labour Party conference today, Home Secretary Shabana Mahmood delivered a forceful speech signalling a tougher approach to UK immigration, outlining new reforms she intends to introduce to the system.
New Conditions for Settlement Rights:
Shabana Mahmood announced that those seeking Indefinite Leave to Remain (ILR) will face stricter criteria. Her proposed requirements include:
- High proficiency in English
- Being in valid employment and contributing to National Insurance
- Having a clean criminal record
- No reliance on benefits
- Voluntary community contributions (such as volunteering) to demonstrate integration
She also indicated that the waiting period before one can apply for ILR may be extended from the current 5 years to 10 years, though “fast-tracking” could be possible for those judged to make exceptional contributions.
Shabana Mahmood stressed she intends to govern as a “tough Labour home secretary,” and that some members might disagree with her approach but that her priority will be maintaining a fair and sustainable immigration system.
Pushback from Charities & Warnings of Risk
Before Shabana Mahmood’s speech, over 100 charities including Save the Children, Oxfam and Shelter wrote to her urging caution, warning that tougher immigration rules risk scapegoating refugees and doing little to address issues like housing or NHS pressures.
Critics argue the new conditions could disproportionately penalise vulnerable groups who may initially depend on support while integrating into UK society.
What Steps Are Coming Next?
The government will launch a consultation on the proposed changes to ILR criteria later this year. The Home Office is expected to explore legal reforms to limit the use of human-rights protections in blocking deportations, particularly in cases involving criminality. Shabana Mahmood’s plan stops short of retroactively revoking settlement rights unlike some of the more radical proposals from Reform UK.
Shabana Mehmood’s speech marks a clear shift toward a more conditional model of immigration one based on “earning” settlement through contribution, behaviour, and integration. Whether her proposals will withstand political, legal, and public scrutiny remains to be seen.
